The Royal Commission's report estimates that at least one third of people accessing residential aged care and home care services have experienced substandard care, and around 39.2 per cent experience elder abuse in the form of neglect, emotional abuse or physical abuse. A number of investigations and reports have also found widespread abuse and neglect in Australia's aged care homes, prompting the government to reform the system by refocusing on older people's support needs. Many new laws and strict governance policies have since been implemented to improve the system and failing to comply with them could result in criminal liability.

Rodney Lewis A.M. is a practising solicitor and a pioneer of Elder Law with over fifty years’ experience in the area of aged care, power of attorney, guardianship, wills and all aspects of older people and their human rights. Currently he is the Senior Solicitor for Elderlaw Legal Services where he helps Australian elder community who have any Elder Law issues or any unlawful restraints in Australia’s aged care system. He also authored the first text on the subject, Elder Law in Australia with a second edition in 2011. Besides that, Rodney is the key figure that pioneered the first course on Elder Law at the University of Western Sydney. He has also promoted significant reform in the elder abuse and in the Australia aged care system.
